General Terms and Conditions


These General Terms and Conditions (GTC) regulate the legal relationship between you as the ordering party/customer and SMART GmbH, Zurich. They apply to every offer proposed by SMART GmbH.
By by submitting an application/order or accepting an offer, the applicant confirms their knowledge of these terms and agrees to be bound by them.

Registration and Payment

We look forward to receiving your order online via our website or by email, telephone or post. An order/application is considered to constitute a binding booking. With your registration you agree to pay for the course by the post office, bank or credit card. Invoices will be sent to the billing address indicated on the order form. The payment date stated in the invoice is binding and SMART GmbH reserves the right to request a deposit, a reminder fee or interest on the outstanding amount.

Cancellation and Retraction

The registration is binding. Cancellation or change of registration is possible free of charge up to 15 days before the start of the course. After this period, the following conditions apply to changes or cancellations.

  • Change of participant – free of charge
  • Change of date – 30% of the course fee.
  • Cancellation or absence – 100% of the course fee.

SMART GmbH decides on the implementation of the course at the latest 15 days before the start of the course. We reserve the right to cancel courses for organizational or technical reasons. In the event of cancellation by SMART GmbH, you have the right to request a rescheduling of the course date or a full refund of the course fee; there are no further claims.

For group bookings of more than 5 people, the dates and numbers are binding from the date of booking.

** courses ordered using vouchers or coupons are not refundable or changeable in the booked dates.
** In case of a refund, the transaction processing fees will be deducted.

Training Services

Duration, price, currency, course objectives, content, target groups and implementation details can be looked up in each course description.
The course fee includes the materials described in the training description as well as refreshments (drinks, coffee, croissants, fruit) during the training. Travel, accommodation and other sustenance expenses are borne by the customer.


All participants who successfully complete the course will receive a SMART GmbH Certificate of course completion. After participants have completed a SMART GmbH course, they receive an exam voucher to participate in the course exam to validate their skills and achieve the corresponding certificate (after passing the exam).

Change of Course Execution

SMART GmbH reserves the right to change the date, location and trainer of the courses.

Copyright and Licensing

These services include the implementation of the course and the provision of the course material for later use by the participant. SMART GmbH grants limited rights to the participant. SMART GmbH reserves further rights, in particular the right to translate, reproduce and republish the course material or parts thereof. No part of the course material may be reproduced, processed using electronic systems, printed or used for public reproduction – including the creation of your own courses – without written permission from SMART GmbH. The use of electronic systems (audio/video) for recording public courses is not permitted without the approval of SMART GmbH.


It is the responsibility of each participant to take out appropriate insurance coverage for all courses and activities organized by SMART GmbH. SMART GmbH is not liable for stolen or lost items. Participants use SMART GmbH equipment at their own risk.


SMART GmbH is permitted to use the services of third parties to implement their programs, regardless of the type and content of the specific program. Swiss law applies to the contractual relationship and its execution. If one or more of these terms and conditions are invalid, the contracting parties will replace the invalid or incomplete provisions as appropriate and in the spirit of the required regulations. The validity of other regulations is not affected. SMART GmbH reserves the right to change its courses and its terms and conditions at any time. The conditions in effect at the time of signing the contract remain in force and you will receive them at the time of course confirmation.
