Terms of Service – SMART GmbH Ads Operator

1. Operator and application

These terms apply to the SMART GmbH Ads Operator, an internal application operated by SMART GmbH, Birkenstrasse 47, 6343 Rotkreuz, Switzerland (UID CHE-348.241.041; commercial register CH-020.4.070.149-3). Contact: info@scalingmicroagile.ch.

2. Authorised use

The application is available only to SMART GmbH employees and authorised contractors for managing and measuring SMART GmbH’s own Google Ads account. It is not a public product, client service or tool for third-party Google Ads accounts.

3. Functions

The application supports account and campaign analysis, reporting, campaign creation and management, keyword planning, advertising asset workflows, conversion-measurement diagnostics and policy-aware operational controls. Individual actions may require internal human review.

4. User responsibilities

  • Use the application only within the authority granted by SMART GmbH.
  • Protect credentials and do not share access with unauthorised persons.
  • Do not access unrelated accounts, circumvent platform controls, or use data for unlawful, deceptive or unrelated purposes.
  • Follow Google’s applicable terms, policies and advertising requirements.

5. Availability and changes

SMART GmbH may change, restrict or discontinue functions to maintain security, compliance or operational quality. Availability depends partly on Google services and API access. No result, campaign performance or uninterrupted availability is guaranteed.

6. Data protection

Use of information is governed by the Privacy Policy – SMART GmbH Ads Operator and applicable data-protection law.

7. Responsibility

Authorised users remain responsible for reviewing proposed advertising changes and complying with internal approvals. To the extent permitted by law, SMART GmbH is not responsible for indirect loss arising from unavailable third-party services or unauthorised use.

8. Governing law

These terms are governed by Swiss law. Mandatory statutory rights and jurisdiction rules remain unaffected.
